These Terms of Sale (“Terms”) govern every purchase from Wicked Peps LLC, an Illinois limited liability company (“Wicked Peps,” “we,” “us”), through wickedpeps.com (the “Site”). By using the Site or placing an order you agree to these Terms, the Research Use Only Policy, the Shipping & Returns Policy, the Cancellation Policy and the Privacy Policy, each incorporated here by reference. If you do not agree, do not use the Site.
1. Research use only
All products are laboratory research supplies sold solely for in-vitro laboratory research by qualified researchers aged 21 or older. They are not for human or veterinary use and not for use in diagnostic or therapeutic procedures. Your attestation to this effect is a condition of every sale and is recorded with your order. Any use contrary to the Research Use Only Policy is a material breach of these Terms.
2. Eligibility and account
You must be at least 21 years old and legally able to enter into a binding contract. You are responsible for the accuracy of the information you provide and for all activity under your account or email address.
3. Orders, pricing and payment
- An order is an offer to purchase. We accept it when we send a shipping confirmation; we may decline or cancel any order before then for any lawful reason, including suspected prohibited use, pricing or listing errors, or payment issues.
- Prices are in U.S. dollars, exclusive of shipping and any applicable sales tax, and may change without notice. Promotional codes have the terms stated when issued and cannot be combined unless stated.
- For orders paid by Cash App, Venmo or other manual methods, the order is held until payment is confirmed. Orders not paid within 48 hours are cancelled.
- Where a card or other processor is offered, the processor’s terms also apply.
4. All sales final; damaged or incorrect items
Because our products are research chemicals in sealed containers, all sales are final and we do not accept returns or exchanges. If an item arrives damaged, defective in packaging, or is not the item you ordered, notify support@wickedpeps.com within 72 hours of the carrier’s delivery scan with your order number and clear photographs of the package, label and item. Verified claims are resolved by replacement or, at our election, refund of that item. Claims outside this window, without photographs, or for items that were opened or used are not eligible. See the Shipping & Returns Policy.
5. Shipping
We ship to addresses in the United States only. Risk of loss passes to you when the carrier accepts the package. Lost or stolen packages are handled per the Shipping & Returns Policy. We are not responsible for delays, misdelivery or returns caused by an incorrect or incomplete address you provided.
6. Disputes and chargebacks
If you have any concern about your order, contact support@wickedpeps.com before contacting your bank or payment provider; nearly all issues are resolved within one business day. You agree not to initiate a chargeback or payment dispute on an order that was delivered as described. Chargebacks filed on delivered, as-described orders are contested with the full order record, including the research-use attestation, acceptance timestamp and network information, carrier tracking and delivery confirmation, and all correspondence. Accounts that file unwarranted chargebacks may be closed and referred for collection of any amounts owed, including dispute fees.
7. Product information
Product pages describe chemical identity, net content, form, container and storage. Specifications are provided for cataloguing purposes and may be updated. We make no representation regarding the suitability of any product for any particular research purpose. No statement on the Site or by our staff should be read as advice regarding use in or on humans or animals.
8. Prohibited conduct
You may not: purchase products for any use other than in-vitro laboratory research; provide false information in the attestation or at checkout; resell products for a prohibited purpose; use the Site in violation of any law; scrape, copy or republish Site content; or interfere with the Site’s operation or security.
9. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN SECTION 4, PRODUCTS AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WICKED PEPS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WICKED PEPS AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING OUT OF OR RELATING TO THE PRODUCTS, THE SITE OR THESE TERMS, HOWEVER CAUSED. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. WICKED PEPS HAS NO LIABILITY WHATSOEVER FOR ANY USE OF A PRODUCT CONTRARY TO THE RESEARCH USE ONLY POLICY.
11. Indemnification
You agree to defend, indemnify and hold harmless Wicked Peps and its members, officers, employees, contractors and suppliers from and against any and all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms or the Research Use Only Policy; (b) any use of a product other than in-vitro laboratory research, including any administration to or use in or on any human or animal; (c) your violation of any law or the rights of any third party; or (d) any false statement in your attestation or order information.
12. Intellectual property
The Site, the Wicked Peps name and marks, product codes, copy, images and design are owned by Wicked Peps LLC or its licensors and may not be used without written permission. Reference compound names and CAS numbers are used for identification only; no affiliation with or endorsement by any third party is implied.
13. Governing law; venue; arbitration
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or a purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court in Cook County, Illinois. You and Wicked Peps each waive any right to a jury trial and to participate in a class or representative action. You may opt out of this arbitration provision by emailing support@wickedpeps.com within 30 days of your first purchase.
14. Changes; severability; entire agreement
We may update these Terms at any time by posting the revised version with a new “Last updated” date; the version in effect when you place an order governs that order. If any provision is held unenforceable, the remainder stays in effect. These Terms and the incorporated policies are the entire agreement between you and Wicked Peps regarding your purchase.
